POWERAPP PRIVACY POLICY

The following privacy policy forms part of the Agreement on Terms and Conditions of Use (“Agreement”) which you have agreed to by downloading and using the POWERAPP application (“POWERAPP”).

 

A.          Privacy Statement

 

Technoforge Development Inc. (TDI) and Technopath Solutions Inc. (TSI) are companies independent of each other. TDI developed PowerApp while TSI is a co-distributor.

 

As developer of PowerApp,  TDI and TSI values the right to privacy and shall ensure that all personal data collected and processed from the users of PowerApp are protected at all times in compliance with the Data Privacy Act of 2012 (“Data Privacy Act”). This Privacy Policy describes the how TDI and TSI collects, handles, and stores personal data.

 

TDI and TSI processes personal data when you use this application to enable the management of cookies, secure IT infrastructure, and to analyze errors. TDI and TSI temporarily stores log files in its web server and analyzes them to identify errors and improve the stability of the application. The storage and analysis of such data is in an anonymized format which will not allow the data subject to be identified.

 

Personal information shall be processed using the principles of Transparency, Legitimate Purpose, and Proportionality.

 

You are required to consent to this Privacy Policy as part of the terms and conditions of use of PowerApp.

 

 

B.          Scope

 

The rights and obligations stated in this policy shall refer only to the personal information collected, processed, and used for PowerApp. It does not cover personal information and data used in the CrowdStrike Falcon platform and other CrowdStrike products, which are covered by separate terms and conditions of use and a separate privacy policy, as indicated here <https://www.crowdstrike.com/privacy-notice/>.

 

TDI and TSI may amend or modify this document to comply with data privacy regulations or to reflect any changes in this privacy policy, or in its collection, processing, or sharing activities. You will be notified of any changes made and you are required to read, understand, and consent to said changes as part of the terms and conditions of use of PowerApp.

 

 

C.           Personal Data Collected and Used

 

TDI and TSI collects the following personal data when you register for and use PowerApp:

 

  • Email address, full name, gender, and phone number, and type of access in the host group (i.e., administrator, analyst, guest). This will enable us to identify the person having access to the application.

  • When you access POWERAPP, TDI and TSI may collect certain information such as the type of device you use, the device unique ID, the IP address of the device, the operating system, the type of Internet browser used, and other diagnostic data, and time and date of use. This will be used for application usage and optimization.

  • This data will only be used for further development of the application and for aggregate studies. The users’ identities, or phone numbers shall not be identified. Where appropriate, your data will be anonymized or aggregated to eliminate individual identifiers, if any.

 

 

D.          Manner of Collecting Data

 

              While your consent may be solicited to obtain and process your personal data above upon registration into PowerApp, we may also process your personal data without your consent.

 

POWERAPP may use tracking applications, for the purpose of improving user experience by analyzing our web traffic data to help us determine our application’s engagement and improve our services and features. This service uses cookies. The web traffic data processed for this purpose include your IP address; pages and internal links accessed on our site; date and time you visited the site; geolocation; the referring site or platform through which you accessed this site; your operating system.

 

 

E. Disclosure of Personal Data

 

              The security of your personal data is important to TDI and TSI, and it shall not share your personal data with any other party unless such disclosure is allowed under Section 12 or 13 of the Data Privacy Act. Only individuals directly involved in the processing of data shall be allowed access to the same. Any other disclosure of data will only be made in conformity with a legal order from a court or government agency or instrumentality with proper jurisdiction to issue the same, as required by law.

 

F. Storage and Retention of Personal Data

 

TDI and TSI stores its files containing personal information in its computers and servers. These are kept in secure environments. TDI and TSI may also store your personal information with cloud-based third-party data storage providers.

 

We store personal data for a period of ten (10) years, during which, inquiries and requests may be made and acted upon in relation to them. After such period, records shall be completely deleted and disposed of. Other categories of data may be kept longer than ten (10) years when the retention period is determined by other relevant Philippine laws and regulations.

 

G. Disposal

 

Physical records shall be disposed through shredding. Digital files shall be anonymized and disposed of such that any personal data cannot be retrieved, processed, or accessed by any person.

 

H. Risks involved in Storing and Sharing of Personal Data

 

In all cases, there shall always be a possible risk of an incident that would result to harm or danger to a data subject or organization. Such risks may result to the unauthorized collection, use, disclosure, or access to personal data, and may have an effect on the confidentiality, integrity, and availability of one’s personal information. TDI and TSI safeguards your data by maintaining a combination of organizational, physical, and technical security measures that are considered by the software industry as commercially acceptable means to protect your personal data. However, TDI and TSI cannot guaranty its absolute security, considering that no method of transmission over the internet or any method of electronic storage, retrieval, or transmission is 100% secure. Among the measures implemented are:

  • Access policies for organizational, physical, and digital infrastructure

  • End-to-end encryption

  • Measures against natural disasters, power disturbances, external access,

  • Technical measures to protect TDI and TSI computers and databases

 

I.            How is your data shared with third parties?

 

              As the POWERAPP is a gateway for the use of the CrowdStrike Falcon application and other related products, you will be sharing data with CrowdStrike, Inc.,  and shall be covered by their EULA and terms and conditions of use, as well as their privacy policy < https://www.crowdstrike.com/privacy-notice/>.

 

              Your personal data may be shared in case of a merger or acquisition by another company. In such case, you will be informed of this fact by a change in this Privacy Policy.

 

              TDI and TSI shall not be responsible for the privacy policies of third-party websites and applications.

 

 

J.           What are your data privacy rights?

 

Under Philippine privacy law, you are entitled to request for the following:

 

  • Access to personal data that TDI and TSI collects or processes about you. You may obtain confirmation on whether or not data relating to you are being processed;

  • Rectification of your personal data if it is inaccurate or incomplete;

  • Erasure or order blocking of your personal data whenever warranted;

  • The right to object if the personal data processing involved is based on consent or on legitimate interest;

  • The right to data portability through which you may obtain and electronically move, copy, or transfer your data securely for further use.

 

 If your personal information is misused, maliciously disclosed, or improperly disposed of, or that your data rights have been violated, you may file a complaint with the National Privacy Commission (NPC)
